PRIVACY POLICY

1. Introduction

FifthGen ("FifthGen", "we", "our") is an unincorporated business operating in New South Wales, Australia. We respect your privacy. This Policy explains how we collect, use, disclose and protect personal information when providing AI voice agent services ("Services") to our business clients ("Clients").

2. Scope

This Policy applies to:

  • callers who interact with FifthGen powered voice agents;
  • Client representatives who provide business or technical information; and
  • visitors who communicate with us by email or phone.

It does not apply to websites we link to or to the independent privacy practices of Third Party Providers.

4. How We Use Information

  • operate, monitor and improve the Services;
  • generate speech, text and structured responses;
  • invoice Clients and calculate Overage Charges;
  • provide customer support;
  • conduct research and develop new features;
  • comply with legal obligations or enforce our Terms.

5. Legal Bases (GDPR / UK GDPR)

When we process personal data of individuals in the EEA or UK, we rely on:

  • Contractual necessity – to perform our obligations to Clients;
  • Legitimate interests – securing and improving the Services, preventing fraud;
  • Consent – where Clients obtain it from callers for optional features;
  • Legal obligation – responding to lawful requests and record keeping.

6. Sharing & Disclosure

We share personal information only as follows:

  • Client Access. Call audio, transcripts and booking data are provided to the Client that controls the agent.
  • Third Party Providers. Speech recognition, language and telephony vendors process data under contract.
  • Corporate Transactions. In a merger, acquisition or asset sale, data may transfer to the successor.
  • Legal Requirements. We disclose data if required by law or valid subpoena.
  • Aggregated Insights. De identified statistics that cannot reasonably identify individuals.

7. International Transfers

Data may be processed outside the country where it originates. We rely on Standard Contractual Clauses or comparable safeguards for cross border transfers.

8. Data Retention

  • Caller Audio & Transcripts. Retained for as long as necessary to provide Services and for a reasonable period thereafter for troubleshooting, analytics and legal compliance, unless Client requests earlier deletion.
  • Logs & Analytics. Typically kept for up to 12 months.
  • Business Records. Invoices and tax records are kept for the period required under Australian law.

Clients may request deletion via support@fifthgen.io; we will remove data from active systems within a commercially reasonable time and from backups per standard rotation.

9. Security

We employ administrative, technical and organisational measures such as encryption in transit, least privilege access controls and continuous monitoring. No system is 100 % secure; Clients must also maintain the confidentiality of integration credentials.

10. Your Rights

Depending on local law, you may have rights to access, correct, delete, object to or restrict processing of your personal data, and to data portability. Submit requests to support@fifthgen.io. We may need to verify identity and may charge a reasonable fee where permitted.

11. Children

Our Services are not directed to children under 16. We do not knowingly collect personal information from them.

12. Changes to This Policy

We may update this Policy periodically. We will post the new version with a revised "Last updated" date and notify Clients of material changes at least thirty (30) days before they take effect.

13. Payment & Billing

We use Stripe to process payments. When a Client pays by credit card, direct debit or bank transfer, Stripe receives the card or bank details directly; FifthGen never stores complete card numbers or bank account credentials. We store purchase order references, invoice identifiers and the last four digits of any payment card solely for reconciliation, dispute handling and tax compliance. Stripe's own privacy policy governs its processing of your payment data.
